On nous a proposé de participer à une compilation, regroupant des artistes autoproduits, et non distribués.
n'étant pas sociétaires sacem, je me demandais s'il était judicieux de signer une autorisation d'exploitation d'une part, et d'autre part si on pouvait prétendre à quelque chose dans ce cas de figure.
attention, je ne réclame pas des droits alors que je ne suis pas inscrit à la sacem, je voudrais simplement savoir s'il y a des termes ou des papiers à signer dans ce cas de figure, et à quoi ils donnent droit en terme d'exploitation, de copie, d'obligations des deux parties, etc...

Rights granted†: with respect to the master as embodied on the Compilation, the non-exclusive right to mix, edit, manufacture, dsitribute, market, advertise, promote, sell, publicly perform and otherwise exploit the same throughout the Territory during the Term and the sell off period, in any manner or medium, now or hereafter known, including, without limitation, through normal retail channels and the internet, or to refrain therefrom. Licensee shall have the right to utilize the Master (and the musical composition embodied thereon) in television- or radio commercials for the Compilation for no additional consideration hereunder. Additionally, Licensee shall have the right to use the name and approved likeness of Artist, as well as the producer and other individual creators of the Master, in connection with such exploitation of the master hereunder.

Term: Perpetuity with a sell-off period of 6 months;

Distribution channels: retail, digital download, club and mailorder
PPD: 2CD approx. Euro 8,-
Number of tracks: approx. 30
Advance:
Royalties: 18% on 100% net PPD, pro rata;
Club and mail order Royalties: 14% on 100% net PPD, pro rata;
Digital Downloads Bundle: above mentioned rate ;
Digital Downloads Separate : 15% of the net received income;
Third Party Licensing: Pro-rated share of 50% of our net royalty
receipt;

Reserves: Limited to 25% after the first six months of
initial release; reserves to be liquidated within 2 accounting periods
Free goods: maximum of 15%
Licensor warranties: Standard, including that you have the sole
