Je pense que dans la carrière d'un groupe, l'ambition de sortir un album qui déchire et qui va se vendre comme des petits pains survient tôt ou tard. Et tant qu'à faire on va envoyer sa petite demo à gauche et à droite, en se disant qu'un label, un producteur, pourquoi pas un
méscène nous remarque.
Et puis un jour le téléphone sonne, un email arrive de la part de quelqu'un... un sauveur, un messie... et on finit par signer un deal... qui àprès la griserie des débuts se révèle être moins cool qu'on pensait voir carrément l'enroule du siècle.

@Splotch : Les producteurs qui ne font qu'investir dans la production d'albums sont aussi sûrement en voie de disparition que les petits disquaires. La plupart des producteurs et labels prennent sur l'édition quand ce n'est pas aussi sur le live et les produits dérivés. C'est ce qu'on appelle les contrats 360°

Bref,aujourd'hui, si un "producteur" ou pseudo-label vous propose un deal sans conditions extrêment dures qui vous font plus qu'hésiter, c'est là qu'il faut vous méfier. Comme le dit souvent un avocat spécialisé que je connais " si ça paraît trop beau pour être vrai... c'est sûrement trop beau pour être vrai"

Je suis actuellement un groupe que j'ai découvert par hasard. Ils n'ont aucun plan marketing et aucun label mais un album extraordinaire. Le buzz se fait pas mal via Facebook où les commentaires sont plus qu'élogieux. Je me demande jusqu'où ils iront sans grosse artillerie derrière eux. Parce que j'entends souvent des artistes se plaindre du peu d'intérêt que leur musique suscite mais parfois à l'écoute de celle-ci on comprend mieux.

et pour rejoindre epebe, une citation de David Sylvian: "ne signez un deal qu'ave cun label qui mise très très gros, parce qu'au moins vous serez surs qu'ils se démèneront pour au moins récuperer leur mise"
je la cite mais je ne suis pas tout à fait d'accord: c'est un appel aux majors et à la concentration, cette citation... elle est donc valable si le groupe cherche à se lier à un geant de l'industrie du disque - dans ce cas, et si c'est possible, faites cracher le label au maximum!
Je laisserai enfin chacun méditer sur cet article de Steve Albini : "the problem with music"

Tant qu'à faire... On a une proposition d'une agence de booking allemande. Je copie/colle le contrat. Si vous pouviez jeter un oeil et me dire si vous voyez une enroule ou une possibilité d'enroule dedans, merci

to sign engagement contracts for CP1. This right is to be conceded worldwide.
The band is also authorized to book performances itself.
§ 2 Agreement
To avoid overlapping promotionativities or appointments the contracting parties commit themselves to informing
each other about appointments in general, special appointments which are in the making and periods of holiday.
CP2 commits itself to agreeing on relevant terms of this contract such as fees, appointments, timetables etc. with
CP1 before signing this contract. CP1 has the right to reject shows before signing a contract.
CP1 receives one copy of the valid contract, one plan of approach and one timetable for the prevailing show
four weeks in advance (alternatively via electronic business is possible too).
§ 3 Obeying of appointments
If CP1 does not fulfil shows or appointments without a medical certificate (except from cases of force majeure)
CP1 will bear all arising costs (fixed penalties and other arising bills).
Exept: illness of Kristell's own child (with medical certificate)
§ 4 Promotion material
CP2 sends everything necessary promotion material (posters, flyers, photos, any other information needed) latest
four weeks before performance to the local organizer in case of all appointments booked by CP2.
After CP1 has made promotion material in sufficient quantities and free of charge available for CP2. As agreed
CP1 can undertake this job if there are any concert inquiries in written form (CP1 meets the cost of postage).
§ 5 Liability in case of damages
The artist represented by CP1 is fully liable for every damage or personal damage caused by CP1
on the concert terrain, in the concert hall, backstage areas, hotels or similar places.
With this CP2 is fully exempted from all claims relating to this.
§ 6 Receipts of concert bills
CP1 is obliged to deliver one copy of the concert bills of each kept appointment to CP2 within the next 14 days.
This effects in particular concerts of which the fee is calculated on the basis of share in admission.
§ 7 Cooperation with third party
CP2 is licensed to ask a third party or to call one into making appointments (performances) for CP1 for a length,
which doesn´t stand in the way of this contract. This is to be coordinated by mutual agreement with CP1 before
involving a third party. CP1 also receives the right to involve a third party but has to take § 2
into consideration when booking concerts.
§ 8 Agency provision
CP2 receives 15 % of the net fee due to the contracts signed for his occupation. For performances on the territory
of the Federal republic of Germany incur supplementary costs because of the German sales-tax (currently 19%
sales-tax). CP1 receives an invoice about the incurred provision which is to be paid within 30 days and without any
deductions. Otherwise interests for default (10,7% p.a.) will mature beginning on the 31st day from invoicing on.
CP2 receives the right to operate as tour manager (by appointment with CP1) and receives an expense allowance
of 80 € (excl. 19% sales-tax) per day which is taken from the net fee or is directly paid by the band.
Arising costs for tour manager´s overnight stays will be born by the local organizer.
§ 9 Payment of tax
CP1 and CP 2 will pay their tax of income themselves.
§ 10 Term of this contract
This contract is valid for 12 months (beginning 01.08.2011) and can be cancelled by each party by 8 weeks´ notice.
If it is not cancelled by one party 8 weeks before passing it is prolonged for another 12 months each time.
Should irreconcilable disagreements appear, this contract can be annulled prior to expiry of the statutory period of
time by an agreement on both sides, with 8 weeks´ notice. In case of appointments, which were booked before
termination of this contract or which last beyond termination, it is arranged that these regulations are applied entirely.
§ 11 Promotion / Advertising campaign
Additional promotion works can (on- and offline) on behalf of CP2 can be booked separately .
Terms: Contract period of ½ a year = 100 € (plus 19 % sales-tax) monthly
Contract period of 1 year = 80 € (plus 19 % sales-tax) monthly.
§ 12 Other
CP1 and CP2 assure each other by means of their signature that they are of age, legally competent,
qualified to sign and satisfied with the significance of this contract. Besides CP1 is obliged to make sure that there
are no claims of a third party, which stand in the way of this contract. Should single regulations of this contract be or
become legally invalid the remaining should not be affected. Any eventually created gaps should be filled to maintain
the meaning and point of this contract. Alterations require written form. Further verbal agreements do not exist.
CP1 and CP2 agree on silence about the regulations of this contract (in particular about the scale

une petite entourloupe de mon côté :
mon frangin a payé 3500€ pour l'enregistrement de son CD, tout c'est bien réroulé pour l'instant sauf que les gars traînent pour finaliser le mixage !!!
L'enregistrement a commencé Novembre dernier...cela fait donc...8 mois qu'ils attendent leur CD !!
Avec un peu de chance le mix va être pourri....
Inutile de préciser que les 3500€ ont été encaissé dès le départ...
mon frangin a payé 3500€ pour l'enregistrement de son CD, tout c'est bien réroulé pour l'instant sauf que les gars traînent pour finaliser le mixage !!!
